1. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into these Terms. Users under 18 represent that they have the consent of a parent or legal guardian.

We verify age through date of birth collection during registration. Users who do not meet the minimum age requirement are not permitted to create accounts.

If you are using the Service on behalf of an organization (such as a school, league, or sports team), you represent that you have the authority to bind that organization to these Terms.

2. Account Registration and Security

To access certain features of the Service, you must create an account. When creating your account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your password
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or use of your account

We reserve the right to suspend or terminate accounts that violate these Terms, contain inaccurate information, or are used for fraudulent purposes.

3. Description of the Service

ScoreBoardNow 2.0 is a sports scorekeeping platform that allows users to enter and broadcast live game scores for sporting events. The Service includes:

4. User Conduct and Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Submit false, misleading, or fabricated game scores
• Use the Service to harass, abuse, or harm other users
• Impersonate any person or entity, or falsely state your affiliation with a person or entity
• Attempt to manipulate the Geo-Scoring system or circumvent location verification
• Upload or transmit viruses, malware, or any other harmful code
• Interfere with or disrupt the Service or its servers and networks
• Scrape, crawl, or use automated means to access the Service without our written consent
• Use the Service for any commercial purpose not authorized by these Terms
• Violate any applicable local, state, national, or international law or regulation
• Upload content that infringes on the intellectual property rights of others
• Create multiple accounts to circumvent restrictions or bans
• Use the eCommerce features to sell prohibited, illegal, or counterfeit goods
• Use the AI chatbot to generate harmful, abusive, or misleading content
• Attempt to manipulate AI scoreboard capture by submitting altered or fabricated scoreboard images
• Use AI features to circumvent score verification or Geo-Scoring controls
• Reverse engineer, probe, or attempt to extract AI model weights, parameters, or training data
• Use AI features for any purpose unrelated to the Service's intended functionality

Violation of these rules may result in suspension or termination of your account. Please refer to our separate Acceptable Use Policy and Community Guidelines for more details.

5. User-Generated Content

5.1 Your Content

You retain ownership of all content you submit to the Service, including game scores, team information, profile images, store listings, and product images ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform your User Content in connection with operating and providing the Service.

5.2 Content Standards

User Content must not contain material that is defamatory, obscene, offensive, discriminatory, or that promotes violence or illegal activities. We reserve the right to remove any User Content that violates these standards or these Terms.

5.3 Accuracy of Scores

You are responsible for the accuracy of any game scores you enter. While we provide tools like Geo-Scoring and trust tiers to promote accuracy, we do not guarantee the accuracy of any scores displayed on the Service. Users should be aware that scores are entered by community members and may contain errors.

5.4 AI-Assisted Content

Scores entered via AI Scoreboard Capture are user-generated content. Although AI assists with extraction, you are responsible for reviewing accuracy before publishing. AI chatbot responses are informational only and are not professional advice.

6. eCommerce Marketplace

6.1 Sellers

If you create a store on the Service, you agree to:

• Provide accurate product descriptions, images, and pricing
• Fulfill orders in a timely manner once payment processing is enabled
• Comply with all applicable laws regarding the sale of goods, including consumer protection laws
• Not list prohibited items including but not limited to: weapons, drugs, counterfeit goods, stolen property, or any items illegal in the buyer's or seller's jurisdiction
• Maintain appropriate inventory levels and accurately represent stock availability

6.2 Buyers

When purchasing items through the Service, you acknowledge that:

• Transactions are between you and the seller; we are a marketplace facilitator, not the seller
• Product descriptions and images are provided by sellers and we do not verify their accuracy
• Payment processing will be handled by a third-party payment processor when enabled

6.3 Fees and Payments

Payment processing functionality is not yet active. When enabled, transactions will be processed through Stripe Connect. We may charge marketplace fees or commissions, which will be disclosed before implementation. Order numbers follow the format SBN-YYMM-NNNNN.

7. Intellectual Property

The Service, including its design, features, code, graphics, logos, and trademarks, is owned by ScoreBoardNow LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written consent.

"ScoreBoardNow" and the ScoreBoardNow cube logo are trademarks of ScoreBoardNow LLC. You may not use our trademarks without our prior written permission.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data collection and use practices.

9. Disclaimers

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from the Service will be accurate or reliable
• Any game scores displayed on the Service are official or verified
• The Service will meet your specific requirements

10. Artificial Intelligence Features

10.1 AI Feature Descriptions

The Service includes the following AI-powered features:

• AI Chatbot: An artificial intelligence assistant that provides customer support, game information, and general assistance to users.
• AI Scoreboard Capture: A computer vision and OCR-powered tool that extracts scores and game information from photographs of physical scoreboards.

10.2 AI Limitations and Disclaimers

AI features are provided as tools to assist you, but are not 100% accurate. Please understand:

• AI features may make errors in understanding, translation, or extraction
• AI outputs should not be treated as a substitute for human judgment or professional expertise
• We do not guarantee the availability, accuracy, or reliability of AI features
• AI features may experience downtime, degradation, or errors without notice

10.3 AI Data Processing

When you use AI features:

• Data (including game images and chat messages) may be processed by third-party AI service providers
• Such third parties may retain data to improve their services, subject to their privacy policies
• Your use of AI features is governed by our Privacy Policy and any third-party AI provider terms

10.4 Intellectual Property in AI Outputs

You understand that:

• Responses generated by the AI chatbot are not owned by you and may be used by us or our AI providers to improve services
• Scores extracted by AI Scoreboard Capture become your user-generated content once you confirm and publish them
• You retain responsibility for the accuracy of any content you publish, regardless of whether it was AI-assisted

10.5 AI Feature Changes

We may modify, improve, suspend, or discontinue AI features at any time with or without notice. The specific AI provider, algorithms, and capabilities may change. You acknowledge that:

• AI providers may change, affecting feature availability and performance
• New AI features may be added to the Service
• Existing AI features may be removed or significantly altered

10.6 Compliance and Transparency

We classify the AI features in ScoreBoardNow as limited-risk artificial intelligence under applicable regulations including the EU AI Act. For EU users, we maintain transparency regarding:

• Purpose: Sports scorekeeping and user support assistance
• Risks: Minor inaccuracies in score extraction and chat responses
• Safeguards: Human review, user confirmation, and control over outputs

11. Limitation of Liability

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Inaccurate game scores or other user-generated content
• Unauthorized access, use, or alteration of your transmissions or content
• Any eCommerce transactions between users

In jurisdictions that do not allow the exclusion or limitation of certain warranties or liability, our liability shall be limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless ScoreBoardNow LLC and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any User Content you submit to the Service.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which ScoreBoardNow LLC is incorporated, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration administered by a recognized arbitration body, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

For users in the European Union, this clause does not affect your rights under mandatory consumer protection laws of your country of residence. You may also bring proceedings in the courts of your country of residence.

14. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us at support@scoreboardnow.com or through the account settings in the app. Upon account deletion:

• Your profile and account data will be deleted within 30 days
• Game scores you have entered will remain as part of the historical record unless you request their deletion
• eCommerce store data and order history may be retained as required by law

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the revised Terms within the app and on our website and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

For material changes that may adversely affect your rights, we will provide at least 30 days' notice before the changes take effect.
